If you want to do construction work - including roading, maintenance and demolition work - that cannot be carried out during the permitted working hours, you can apply for an exemption.

The Council grants exemptions when it is satisfied the work cannot be done at any other time because of traffic, safety, access or other constraints.

To request an exemption you must provide all necessary information to the Council, at least 48 hours prior to the proposed work starting.

Confirmation that the exemption is granted must be received before work starts.

Requesting an Exemption

You will need to provide the following information to Noise Control officers to receive an exemption:

  • The reason for the work and why it has to be done outside permitted hours.
  • The type of work and what equipment will be used.
  • The work location and distance from residents.
  • How long the work will go for and when it will take place.
  • Predictions for the noise level as it reaches residential properties within ear-shot. You need to consider geographical features that may concentrate the noise, like valleys and wind.
  • If the work is going to take a long time you should have an acoustic consultant's report showing how the noise can be mitigated.
  • Evidence of consultation, such as letters, with any potentially affected parties, and the outcomes of that consultation.

Submitting Your Information

Before submitting written information to the Council, it is a good idea to discuss your proposed works with a Noise Control officer.

Ensure you have the information to the Council at least 48 hours before the proposed work's start-time.

Your request will be considered by Noise Control officers and you will receive confirmation that an exemption has been approved or declined.

Advising Other Parties of Your Approved Exemption

If your exemption is granted you will need to advise adjoining residents or other affected parties about the proposed works before they commence. The Notification of Proposed Works form can be printed onto your company's letterhead, completed and given to other businesses or residents who may be affected by the works.
