The Council makes most decisions about local liquor licences in its capacity as a District Licensing Agency (DLA). The DLA or Police may also refer licensing issues to the national Liquor Licensing Authority (LLA).
In New Zealand, city and district councils act as DLAs. All applications for liquor licences are filed with the DLA that has jurisdiction over the site of the proposed licensed premises.
The DLA considers and determines all uncontested applications for on, off, club and special licences, renewals, variations, temporary authorities and manager's certificates.
The Wellington DLA operates from the City Council's Building Consents and Licensing Services Directorate (BCLS).
The LLA is the national body for liquor licensing. The LLA consists of a District Court Judge (who is the chairperson) and three members. They are appointed by the Governor-General on the recommendation of the Minister. The LLA:
All applications for licences, renewals, variations, temporary authority and manager's certificates are investigated by various bodies. Investigations gather and assess information about the premises and the suitability of the applicant.
The Licensing Sergeant receives a copy of all liquor applications. Background checks for convictions are done on the individual applicants, members of partnerships, and directors and shareholders of the applicant company.
The Police monitor all licensed premises on an ongoing basis to ensure they comply with the Sale of Liquor Act.
Licensing Inspectors are appointed by the DLA. The Inspector investigates the suitability of applicants, the employment of certified managers, host responsibility practices, issues surrounding operating hours, and the proposed use and designation of the premises.
The Inspector also monitors licensed premises for compliance with the Act.
In Wellington the Medical Officer of Health (MOH) is represented by the Public Health Service. The MOH reports on licence applications and renewals.
The MOH also monitors licensed premises for compliance with the Act and Host Responsibility practices.
