When we receive a resource consent application, the Council assesses its environmental effects. If these are more than minor we have to notify the public about the resource consent application. This is a requirement under Section 95A of the Resource Management Act 1991.
The submission period for notified resource consents is 20 working days. After the submission period closes a hearing date is set.
The Hearing Committee has 15 working days after the hearing to consider the application and release a decision. After the committee has released their decision, the applicant and submitters have the right to appeal within 15 working days.
Appeals are lodged with the Environment Court, which is likely to ask the parties to undertake mediation. If the concerns can't be resolved in mediation, then the matter will go to an Environment Court hearing.
If the Council wants to protect land as reserve, we have to do so under the Reserves Act 1977.
The classification reflects the primary use or purpose of each reserve. The classification binds the Council and gives the community certainty about the activities that can take place on the land. In most cases, the Council will notify its intention to classify land as reserve.
Sometimes the original classification of a reserve may no longer be the most appropriate and the Council will notify its intention to 're-classify' the reserve.
The process for road stopping is covered under section 342(1) of the Local Government Act 1974.
